Please read these terms and conditions outlined herein carefully, which define the contractual relationship between you (the client) and See4yourself-Tours (the Company). By booking you accept these terms and conditions.
1. The Booking
1.1 This booking and subsequent contract shall be deemed to have been concluded in Johannesburg, South Africa and shall be interpreted according to the laws of the Republic of South Africa.
1.2 The parties consent to the jurisdiction of the Magistrates Court of Johannesburg. The law of the Republic of South Africa shall prevail.
1.3 When you make a booking and pay a deposit, subject to availability (see below) we will issue our confirmation invoice. A contract will come into existence at this point. Check the confirmation invoice carefully and let us know immediately if there are any errors or discrepancies as it may not be possible to make changes later. No booking shall be considered confirmed until the full amount due paid and all cheques honoured.
1.4 All prices and services are to the best of our knowledge and believe true and correct at the time of printing. All services and departures are subject to change without prior notice. Quotations are only valid to the expiry date stated on the quotation.
1.5 The Company accepts no liability for any inaccuracies contained in its brochures/CD-ROMs/websites/itineraries, as well as in those of the supplier of the services.
1.6 The Company reserves the right to alter the published price of any tour due to increasing tariffs, costs and entry fees or fluctuation of exchange rates, such amounts shall be determined at the sole discretion of the company.
1.7 The Company reserves the right to alter or substitute routes, tours, accommodation, conference/function venues, refreshments, meals, itineraries, services, vehicles and/or arrangement should conditions necessitate. The Company will offer substitutes of equal value and will inform the client of any known changes.
1.8 The Company will not accept any booking where the booking form is unsigned or incomplete in any respect.
2. Payment
2.1 A non-refundable 15% deposit of the full payment is required to secure a booking. This amount forms part of the payment for the trip and shall be offset to the total amount charged to the client.
2.2 Three months prior to travel at least 50% of the full payment must be made.
2.3 If the full amount is not paid 1 month prior to departure, the Company reserves the right to treat the booking as cancelled and the full deposit (15% of the full payment ) shall be forfeited.
2.4 Clients booking within 1 month of tour departure are required to pay the full amount immediately to secure a seat.
2.5 Payment shall be made in all instances in the currency in which the quotation was accepted. All bank charges are the responsibility of the client.
3. Cancellation
3.1 Any cancellation by the client must be in writing. The date on which the Company receives the letter will determine the cancellation charges applicable. In the event of cancellation the following charges will apply: 1 month or more prior to departure – full deposit. 30 to 21 days prior to departure – full deposit plus 30% of the tour price. 20 to 14 days prior to departure – full deposit plus 60% of the tour price. 13 days or less before departure – full tour price. If a client wishes to change a booking from one tour to another, 1 month prior to departure and the Company agrees, an administration fee of R250 will be charged. Normal cancellation fees will apply if a client wishes to make changes within 30 days of departure.
3.2 Any client joining a tour after the departure date, or not at all, or leaving before the completion of the tour for any reason whatsoever, is not entitled to any refunds whatsoever from the Company, or entitled to claim any costs for any added expenses.
3.3 The Company reserves the right to cancel any tour at its sole and absolute discretion, without prior notification in instances where this is unavoidable. However, in this instance the Company agrees to refund all monies already paid by the client. This shall be the Company’s sole responsibility to the client and no claim for any damages, howsoever arising, shall accrue against the company.
3.4 Tours are subject to a minimum booking of five (5) passengers. If that number is not obtained, the Company reserves the right to cancel the tour. In the event of a tour being cancelled for whatever reason, the client may choose a full refund of all monies paid, or alternatively any other tour that the Company may offer. No further liability by the Company to the client with regard to the cancellation will arise. In the event of a passenger selecting an alternative tour offered by the Company which is lower in price than the original tour, then the client will be entitled to the difference or alternatively, if the tour is more expensive, then the client will be liable for the additional cost.
3.5 All travel arrangements made by the Company, such as reservations of accommodation establishments, flight bookings, tour reservations, conference/function venue reservations, reservation of transport and the like, are subject to the booking conditions and cancellation provisions of the supplier thereof.
4. Travel Documents
4.1 It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations and any other required documentation are all in order for the countries to be visited.
4.2 The Company cannot be held liable for any consequences, damages or claims if the client prior to commencement of the tour does not correctly attend to the client’s documentation and related matters.
5. Insurance
5.1 Clients must obtain personal travel insurance and are urged to ensure that it is adequate for the full duration of the arrangements, particularly in respect to accident, medical and repatriation expenses. If the client has dependents, insurance is also recommended. Any resulting consequence of not having this insurance is the sole responsibility of the client.
6. Risk
6.1 The client accepts that all trips are of an adventurous nature and involves an element of personal risk, and that neither the Company nor it’s agents can be held liable for any injury, loss and/or damage to property or loss of life caused. The client accepts responsibility for all risks involved.
7. Health
7.1 The client accepts that to participate in the tour requires a measure of physical fitness and health and it is the client’s obligation to ensure that they are medically fit to embark on the tour.
8. Authority on tour
8.1 The decisions of the Company’s guide and/or driver on tour shall at all times be final and binding.
8.2 The client must at all times comply with the laws, customs and foreign exchange regulations of all countries visited.
8.3 Clients may not carry any unlawful firearms, articles or substances, whether on a tour or a transfer or staying at any accommodation establishment.
8.4 In accordance with South African law and International practice smoking is prohibited on vehicles at all times.
8.5 Should the client be in any contravention of the above or the client is a nuisance to the group the driver and/or guide may order the client to leave the tour without any claim to a refund. The client shall be responsible for his own repatriation.
9. Baggage
9.1 All baggage and personal effects are at all times the client’s responsibility and the Company does not accept any liability for any loss or damage of any personal effects, howsoever arising.
9.2 Clients are entitled to one suitcase not exceeding 20 kg and an overnight bag not exceeding 10 kg. Should the client require a larger baggage allowance, this can be arranged at the discretion of the Company and on payment of a fee that the company may levy. The Company retains the right to refuse excess baggage.
10. Marketing
10.1 The company reserves the right to use any photographs and video taken during tours for use in marketing or any other advertising material and the client hereby gives consent of such photographs to be used and for the Company to retain copyright over such photographs.
11. Force Majeure
11.1 Force Majeure means any event which the Company or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, accident, sickness, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside the Companies control. The Company shall not be held liable in any way for any of these possible occurrences or any consequences, which may arise as a result of these.
